Background
MEP was approached by our client to regularise the existing residential use of the site. As the building was listed, a Certificate of Lawfulness for an Existing Use (CLUED) was required, with an accompanying application for listed building consent.
The application sought to confirm that the ground floor of the property had been used as three residential flats for a period of time exceeding 10 years. The works had been undertaken following a fire and whilst the necessary building regulation had been obtained, the relevant planning permission or Listed Building Consent had not been obtained.
